Chiropodist struck off following sixth review hearing

Chiropodist Amin M Sain has been struck off the HCPC Register following a sixth review of a conditions of practice order imposed in February 2009. This latest review follows a hearing in July 2015 which imposed a further conditions of practice order for a period of six months.

Mr Sain was originally suspended on grounds of misconduct after practicing the treatment of minimal invasive surgery without the full underpinning surgical knowledge necessary to perform this type of surgery safely, therefore acting beyond his scope of practice. A panel of the HCPC Conduct and Competence Committee conducted a sixth review of a conditions of practice order imposed for three years on 26 February 2009. It follows two periods of suspension and three further conditions of practice orders.

The Panel heard that Mr Sain has not engaged with the HCPC since January 2015. In the absence of any evidence produced for this review, the Panel concluded that his fitness to practise remains impaired.

Panel Chair Manuela Grayson commented:

?The Panel was satisfied that there was little alternative in the specific circumstances of this case than to conclude that there remained a significant lack of insight from Mr Sain and that he had demonstrated, over an extensive period of time, an inability or unwillingness to resolve the failings identified in respect of his fitness to practise. As the Panel already noted, Mr Sain has had very many opportunities to demonstrate that he is fit to remain on the register, but he has not done so.?

The Panel concluded that the necessary and proportionate sanction to impose is a striking off order.

As well he may as an unregistered podiatrist and perfectly legally too. He will not be able to perform restricted functions covered with the pod surgery annotations (yes,we do have some protected functions after all - as well as a restricted scope of practice) but he can practice as a podiatrist under that title providing he makes it clear he is no longer registered. Unless he enrols on a voluntary register where he probably can state he is a registered podiatrist.

At least his burrs will now only grind down toenails. And the public can rest in peace...
