Former Harlequins physiotherapist Steph Brennan has won a court case over his dismissal by the Health Professions Council for his role in "bloodgate".

Mr Brennan's lawyers accused the HPC of unlawfully imposing a two-year ban after winger Tom Williams faked injury during the Heineken Cup in April 2009.

It was dubbed bloodgate after the player bit into a fake blood capsule

Mr Justice Ouseley, sitting at the High Court, quashed his dismissal and ordered the HPC to reconsider the case.

Would I be correct by saying this is the first time a sanction from the HPC has been successfully challenged in court? The doctor who actually cut the lip of the player involved was only given a warning by the GMC about her conduct. On that basis, I have to agree that whilst the action of the physio was clearly dishonest, striking them off seems out of proportion with the punishments meted out to the others involved in this sordid little episode
