Podiatrists To Pay $574,014 Settlement For Medicare Over Billing

Mid-West Podiatry and Associates, Drs. Jeffrey Brooks, DPM, H. John Visser, DPM and Robert K. Duddy, DPM have together agreed to pay the United States a total of $574,014 to settle litigation filed by a "whistleblower" against them relating to billing practices for podiatric care of medicare patients from October 1996 to July 2003.

Mid-West entered into this settlement with the Department of Justice on behalf of the Office of Inspector General of the Department of Health and Human Services. The settlement resolves allegations that Mid-West used a computer system which automatically generated information which caused claims to Medicare Part B to be approved by Medicare as covered services when in fact they should not have been approved.

The allegations were made by a "relator" under the qui tam provisions of the False Claims Act.

The relator was a podiatrist who was formerly employed by Mid-West. Under the Act, the relator can recover from 15 to 25 percent of the damages paid to the United States, if the government intervenes in the action.
