    Ok, I read the above before reading Marks post in the Regulation of Podiatry thread and I get the context.

    "case stated" is when one court asks the opinion of another court on a point of law, so assume that case stated procedure is the procedure for doing that.

    Usually one side or the other can ask ask another court/judge for clarification as to the law on an issue disputed. In this case it's in both Mark's and the HCPC's interest to clarify the position in regard to the claim that the legislation in regard to the HCPC is 'permissive' rather than 'mandatory' as it was with the CPSM.

    If it were found to be permissive we could all deregister !

    This has nothing to do with the fact the case was mis-presented by the HCPC and therefore 'set aside'.
