Jury sides with podiatrist in wrongful death case

David Bushong died in 2009 from a rare form of cancer discovered two years earlier. Six months before the cancer was diagnosed, Dr. David Huebner saw Bushong for a growth Huebner diagnosed as a ganglion cyst. A different doctor later located the cancer with a new MRI and amputated Bushong's leg below the knee, but it was discovered too late and the cancer spread to the rest of Bushong's body.
In April 2011, Bushong's family filed a suit alleging Huebner was negligent when he didn't ask a pathologist to test the fluids from Bushong's cyst for cancer. But a 12-person jury on Thursday decided Huebner didn't fail Bushong, and that the cancer was so rare that it would have been outside Huebner's reasonable protocol to have the fluid tested.

Good point of just how far should you need to go in those extraordinarily rare conditions in order to protect your butts.

Everything taken from the body goes to a pathologist. In places where pods are not allowed to do this (law or insurance blocks) then I guess document clinical appearance to justify diagnosis.
