McCahren said Stapp failed to meet the proper standard of care in treating Downing's foot. Stapp opted for an unnecessary, invasive and expensive surgery instead of first exploring more conservative treatment methods such as orthotics or injections, McCahren said. Stapp did not look at X-rays before performing the surgery, then cut a tendon during the procedure, McCharen said.
After the first surgery, Stapp "duped" Downing into a second surgery, McCahren said.
However, Reed Rasmussen, Stapp's attorney, told jurors the podiatrist's treatment was proper and that another podiatrist will testify to that fact during the trial. It's not true, Rasmussen said, that Stapp did not look at Downing's X-rays or consider other options. And Stapp's surgery recommendation was the second such opinion given to Downing.
