Lawyers representing The Finley Hospital questioned Dr. Michael Arnz, of Dubuque Podiatry, Friday in an attempt to prove to a jury he was not operating outside the scope of his expertise.

In the afternoon on the fourth day of an anticipated 15-day medical negligence trial, attorneys representing plaintiff Daniel Day and defendant Finley Hospital also cross-examined a board certified expert in infectious diseases, Dr. Jerrold Dreyer.

Day, of Dubuque, seeks monetary damages from the hospital, alleging it was negligent in granting staff privileges to Arnz, who performed a procedure on Day in July 2004. Arnz is no longer a party to the lawsuit after agreeing to a confidential settlement.

Using a timeline provided by Finley attorney Connie M. Alt, Arnz explained when antibiotics were administered to Day after some symptoms of infection around Day's circular leg frame were noticed. The frame was installed for bone stabilization following a surgery to correct a foot deformity related to a genetic condition.

Arnz testified the medicine appeared to stop the symptoms of infection, and there were no compelling clinical symptoms leading Arnz to consider a bone infection had occurred.

"If you have a raging bone infection, the skin holes will open up again -- the puss underneath needs to go somewhere" if there is an infection, he testified.

Arnz also testified that the tibia bone, where a circular leg frame was pinned, has a lower blood flow nearby that is conducive to infection. But he said a podiatrist is familiar with the bone and capable of inserting and monitoring pins into the bone because of its close proximity to the foot.

Day's lawyers disagreed and said some-one more familiar with the bone should have been consulted, or someone familiar with different kinds of infections.

Dreyer, who practices medicine in California, disputed Arnz' opinion and said after reading nurse and doctor descriptions of Day's symptoms before and on Oct. 21st, "At some point, you have to connect the dots and think of a (bone infection). All the red flags go up."

"By Oct. 21st, it was a done deal; (Arnz) should have asked for help or done something more at that time," Dreyer said.

Arnz continued to administer medicine that would stop a form of infection on the skin or tissue level in the two months before Oct. 21st.

When asked three times by Daniel Day's attorney, Timothy S. White, and after two objections by attorneys for Finley, Dreyer said, "Based on this case and the fact he did not put all things together, he showed himself to be incompetent."

The defense again asserted that Arnz was not on trial, and Dreyer acknowledged he was not indicting the hospital's competency in his testimony.

A jury has found that a Dubuque hospital was not negligent in a case involving a patient who developed a bone infection following surgery.

Daniel Day of Dubuque alleged Finley Hospital was negligent in giving credentials to Dr. Michael Arnz, a Dubuque podiatrist. Day developed a bone infection after Arnz performed surgery using a circular frame, which necessitated the insertion of surgical pins through Day's right tibia.

Arnz was removed from the lawsuit after earlier agreeing to a confidential settlement.

Day had sought about four million dollars for loss of earnings and future medical expenses from Finley.

Appeal filed in Finley negligence trial

Attorneys representing a Dubuque man in a negligence trial against The Finley Hospital filed a notice of appeal to the Iowa Supreme Court on Thursday.

Daniel Day and his attorneys originally filed a motion for a new trial, which was denied by a judge on Jan. 18. The motion was filed after a two-week trial and ruling by jurors in Dubuque County District Court that Finley was not negligent when Day developed a bone infection after foot surgery.

The foot surgery was conducted by Dr. Michael Arnz, of Dubuque Podiatry. Arnz agreed to a confidential settlement and is no longer a party to the lawsuit.
